At TEFListening.ca, we mandate strict data handling protocols. This policy details exactly how your data is collected, utilized, and protected.

2.1 Information We Collect

Personal Data: We collect your name and email address at the time of account registration.

Email communications: The email address you provide during sign-up may be used to send you communications for required account updates and information about the service, as well as marketing emails.

Usage and Performance Data: We actively track your test scores, completion rates, and platform navigation to populate your personal dashboard and improve our testing algorithms.

Technical Data (Cookies): We use a strictly necessary session cookie (__session) to keep you logged in when you visit protected pages (e.g. Profile, Practice, Review). This cookie is essential for the site to function and is not used for tracking or advertising. We also use Google Analytics, which may set cookies and similar technologies to measure traffic and understand how the site is used. Payment Data: We do not collect or store full credit card numbers. Payment processing is outsourced entirely to Stripe.

2.2 Third-Party Service Providers

We utilize specialized sub-processors to operate this platform. By using our service, you consent to the processing of your data by:

Google (Firebase): Utilized for web hosting, cloud database management (Firestore), and user authentication. Your data is encrypted and stored on Google Cloud infrastructure.

Google Analytics: We use Google Analytics to understand how visitors use our site (e.g. page views, traffic sources). This helps us improve the service. Google Analytics may collect identifiers and usage data as described in Google's Privacy Policy and How Google uses data when you use our partners' sites or apps.

Stripe: Utilized for secure payment gateways. Their use of your personal information is dictated by their distinct Privacy Policy.

2.3 Data Security and Breach Protocols

We implement rigorous, industry-standard security measures (including SSL encryption and secure database rules) to protect your data. However, internet transmission is never entirely secure. You provide your personal information at your own risk. In the highly unlikely event of a data breach compromising your personally identifiable information, we will notify you via the email address on file in accordance with applicable provincial and federal regulations.

2.4 Your Rights (PIPEDA Compliance)

In alignment with the Personal Information Protection and Electronic Documents Act (PIPEDA), you retain full authority over your personal data. You have the right to:

  • Access: Request a copy of the personal data we hold about you.
  • Rectify: Update or correct inaccurate information within your account profile.
  • Erase: You may permanently delete your account and all associated performance data directly through your Profile settings at any time. Once initiated, this action is irreversible.

Welcome to TEFListening.ca. By accessing, browsing, or using our services, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions. If you do not agree to every provision of these Terms, you must immediately cease using the platform.

1.1 Disclaimer of Affiliation

TEFListening.ca is an independent, third-party test preparation platform. We are not affiliated with, endorsed by, or connected to the Paris Ile-de-France Chamber of Commerce and Industry (CCI Paris IdF), Immigration, Refugees and Citizenship Canada (IRCC), or any official administrators of the TEF (Test d'Évaluation de Français) Canada exam.

1.2 Services Provided and "As-Is" Warranty

We provide digital test preparation materials, including audio files, transcripts, and practice questions. Access to certain content requires a one-time payment for a specific duration ("Access Period").

Our services and materials are provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the materials are entirely error-free, nor do we guarantee any specific score, outcome, or success on the official TEF Canada exam.

1.3 User Accounts and Termination

Accountability: You must provide accurate, current, and complete information when creating an account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Authentication: We utilize Firebase Authentication to manage credentials securely.

Termination Rights: We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

1.4 Payments, Strict No-Refund Policy, and Chargebacks

Processing: All payments are processed securely through our third-party provider, Stripe. We do not process or store credit card data.

Strict No-Refund Policy: Due to the immediate access to digital proprietary content, all sales are strictly final. Once a premium pack or access period is purchased and access is granted, we do not offer refunds, partial refunds, credits, or exchanges under any circumstances.

Term Expiration: Your access automatically expires at the exact end of your purchased term (e.g., 30, 90, or 180 days).

Chargebacks: Any unwarranted chargebacks filed by you will be considered a breach of this agreement and will result in immediate permanent account termination. We reserve the right to dispute chargebacks using your usage logs as evidence of access and consumption.

1.5 Intellectual Property and Acceptable Use

Ownership: All content on the platform—including audio recordings, code, UI design, question text, and transcripts—is the exclusive property of TEFListening.ca and is protected by international copyright laws.

Limited License: You are granted a limited, revocable, non-exclusive, non-transferable license to access the content strictly for personal, non-commercial study purposes.

Prohibited Conduct: Recording, screen-capturing, copying, distributing, scraping, data-mining, or selling our content is explicitly prohibited. Violations will result in immediate account termination and potential legal action.

1.6 Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall TEFListening.ca, its founders, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of your access to or inability to access the service. In no event shall our total liability to you exceed the total amount you paid to us for the specific access period in dispute.

1.7 Indemnification

You agree to defend, indemnify, and hold harmless TEFListening.ca from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the platform.

1.8 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Ontario.
